O plantão judiciário noturno, instituído no âmbito dos tribunais brasileiros por meio da Emenda
Constitucional nº 45/2004, que modificou o art. 93, inciso XII, da Constituição Federal de 1988,
permite o ingresso de ações mesmo durante a madrugada, nos moldes estabelecidos na 33/2014
do TJRJ, o plantão somente pode ser utilizado em situação de urgência, sendo recorrente a
requisição da concessão de tutelas provisórias. No tocante ao direito fundamental à saúde,
quando há o risco de perecimento do indivíduo acometido por moléstia, a morosidade nas
decisões judiciais pode agravar o problema de saúde. Nesse contexto, a tutela de urgência em
caráter antecedente, inovação do CPC/2015, se encaixaria no panorama do plantão noturno do
Judiciário e poderia evitar uma judicialização desnecessária. O presente estudo, realizado em
sede de dissertação de mestrado, teve por objetivo abordar a judicialização da saúde e os seus
impactos no plantão noturno, sob a perspectiva da atuação do Poder Judiciário a respeito da
concessão ou da negativa de pedidos fundamentados no direito à saúde. Para tanto, o trabalho
utilizou o método hipotético-dedutivo, em análise qualitativa, por meio da revisão doutrinária
e jurisprudencial, além da legislativa, bem como apresentou /dados colhidos nos meses de
janeiro e junho de 2017, referentes ao plantão noturno do Tribunal de Justiça do Estado do Rio
de Janeiro - TJRJ, em forma quantificada em gráficos. Os resultados mapeados apontaram que
mais da metade dos pedidos apresentados durante o plantão noturno se referem a questões de
saúde, pública ou privada, bem como estavam combinados com requisições de tutela
provisórias de urgência, evidenciando índices elevados de judicialização em questões de saúde.
Por fim, o presente estudo também desejou oferecer uma humilde contribuição aos debates
sobre o direito à saúde como uma garantia fundamental, numa realidade ainda distante da
devida segurança jurídica que se espera de uma Democracia fundada no Estado de Direito.
Abstract
The judicial nocturnal duty, established in the scope of the Brazilian courts through
Constitutional Amendment 45/2004, which modified the article 93, XII, of the Federal
Constitution of 1988, began to provide for judicial activity as being uninterrupted and made it
possible to file petitions even during the night, especially when the request under discussion
refers to some legal object involved in an emergency, requesting the grant of summary
judgements. With regard to the fundamental right to health, when the risk of death of the
individual affected by illness can be aggravated by delays in judicial decisions, the emergency
guardianship in the of the summary judgements gains even more space in the panorama of
nocturnal duty of the Judiciary. Therefore, the present study, carried out in a master's thesis,
had as objective to approach the judicialization of health and its impacts in the night duty, from
the perspective of the Judiciary's action regarding the granting or refusal of requests based on
the right to health. For this, the work used the hypothetical-deductive method, in qualitative
analysis, through the doctrinal and jurisprudential revision, besides the legislative, as well as
presented data collected between the months of January to June of 2017, referring to the night
shift of the Court of Justice of the State of Rio de Janeiro - TJRJ, in quantified form in graphs.
The results showed that more than half of the requests submitted during the night shift refer to
health issues, public or private, and were combined with urgent requests for guardianship,
evidencing high levels of judicialization in health matters Finally, the present study also wished
to offer a humble contribution to the debates on the right to health as a fundamental guarantee,
in a reality still far from the due legal certainty that is expected of Democracy based on the Rule
of Law.
