O presente artigo aborda o fenômeno da “judicialização” das políticas de saúde, que surge às vésperas dos 20 anos da Constituição Brasileira de 1988 e insere a saúde como um direito de todos, a partir de um caso concreto ocorrido no município de São José do Rio Preto, São Paulo. O objetivo é a dissertação sobre os principais aspectos jurídico legais da decisão judicial proferida naquele município, e suas implicações na política de saúde local, relacionando-os à onda de decisões judiciais sobre o tema da saúde, ocorrido na atualidade, bem como ao referencial teórico de Niklas Luhmann e sua teoria dos sistemas.
Resumen en ingles
The presente article approaches the phenomenon of “judicialization” of thw health policies, which starts on the eve of the 20 years of the Constituição Brasileira of 1988 and puts health as a right of everybody, from a concrete case that occurred in the city São José do Rio Preto, São Paulo, Brazil. The aim is to dissert about the principal legal and juridical aspects of the judicial decisions on health, occurring nowadays as well as the the theoretical referential of Niklas Luhmann and the systems theory.
