O artigo 5°, inc. XXXV da Carta Magna assegura o direito dos cidadãos se valerem
do Poder Judiciário no caso de violação ou ameaça de lesão aos seus direitos. É,
nesse sentido que assegura o acesso ao Judiciário para a garantia do direito à
saúde. Assim, na omissão ou mesmo ineficácia do Estado em prestar assistência
médico-farmacêutica, o Judiciário, mediante provocação, pode determinar que o
Estado cumpra os ditames legais, e garanta ao indivíduo o medicamento ou o
insumo pleiteado. O Superior Tribunal de Justiça vem assegurando o direito à vida e
à saúde, os direitos sociais e individuais, o bem-estar e a justiça como valores
constitucionalmente consagrados.
Abstract
The article 5°, incorporation XXXV of the Great Letter assures the right of the citizens
to use the Judiciary Power in the case of breaking or threat of injury to its rights. It is,
in this direction that assures the access to the Judiciary one for the guarantee of the
right to the health. Thus, in the omission or same inefficacy of the State in giving to
assistance doctor-druggist, the Judiciary one, after provocation, determines to the
State that fulfills the ditames legal, and guarantees to the individual the medicine or
insumo pled. The Superior Court of Justice guarantees the right to the life and the
health, assuring the social and individual rights, well-being and justice as values
constitutionally consecrated.
