A concepção da saúde como um direito individual e social avançou na mesma
conjuntura política da ampliação do papel do Ministério Público brasileiro, em um
movimento de mudança de paradigma em relação à proteção social. Sob a ótica de
afirmação da ampliação da responsabilidade pública pelos direitos inerentes à cidadania,
a pesquisa apresenta um estudo exploratório que demonstra como o Ministério Público
vem enfrentando o desafio da fiscalização de arranjos e instrumentos pósconstitucionais na política de saúde, como as relações contratuais que se estabeleceram,
de diferentes formas pelo país, entre o Estado e as chamadas Organizações Sociais
(OSs). Diante da proliferação dos contratos de gestão e da demora no julgamento
definitivo da Ação Direta de Inscontitucionalidade n. 1923-DF, que questionou a
constitucionalidade da Lei das Organizações Sociais perante o Supremo Tribunal
Federal, algumas estratégias não uniformes de ação foram trilhadas pelos diversos
órgãos do Ministério Público, como agente político capaz de pautar e modelar decisões.
Este estudo busca analisar o que as determina e os seus resultados. O
neoinstitucionalismo foi adotado para a abordagem teórico-metodológica, em análise às
seguintes dimensões de estudo: a influência da atuação do STF no julgamento da ADIN
1923-DF; a influência da política local e seus atores para implantação do novo modelo
de governança na saúde; e a independência funcional dos membros do MP. As
estratégias metodológicas foram a revisão bibliográfica e a análise documental de atos
normtativos, jurisprudência, mídia impressa e eletrônica, peças processuais e roteiros de
atuação. Foi, ainda, realizado um estudo da atuação do Ministério Público de São Paulo,
que incluiu entrevistas com atores-chave, diante do pioneirismo deste estado, no Brasil,
em contratar OSs para gerir unidades de saúde. A pesquisa demonstrou que a validação
do novo modelo de gestão pelos tribunais se pautou em um julgamento político, sem que
se tenha identificado bases empíricas para sua legitimação. A cultura técnico-burocrática
dos membros do MP pautou o enfrentamento desta inovação administrativa pelos seus
membros. Todavia, a forma desarticulada de contratação pelo território nacional
favoreceu a falta de uniformidade de atuação da Instituição, influenciada, ainda, pelo
subjetivismo e pelas diferentes posições político-ideológicas que são justificadas sob o
pálio da prerrogativa de independência funcional dos membros do MP. Apesar da
retórica em prol da eficiência, transparência, economicidade e participação popular
usada pelos Poderes para implementar o modelo de gestão por OS na saúde, a
fiscalização feita pelo MP tem revelado ausência de participação e controle social,
deficiências graves na assistência à saúde, baixo controle público, corrupção e vultuosos
desvios de recursos públicos. O MP, atualmente, dedica-se em aprimorar a fiscalização
dos contratos de gestão.
Abstract
The conception of health as an individual and social right advanced in the same political
context of the expanding of the Brazilian Prosecution Service´s role, in a movement of
paradigm shift in relation to social protection. From the perspective of affirming the
expansion of public responsibility for the rights inherent in citizenship, the research
presents an exploratory study that shows how the Prosecution Service is facing the
challenge of monitoring arrangements and post constitutional instruments in health
policy, such as the contractual relations established in different ways across the country,
between the State and the so-called Social Organizations (SOs). Given the proliferation
of management contracts and the delay in the final judgment of the Direct
Unconstitucional Act n. 1923-DF, which challenged the constitutionality of the Social
Organizations Law before the Supreme Court, some non-uniform action strategies were
followed by the various organs of the Prosecution Service as a political agent capable of
guiding and shaping decisions. This study seeks to analyze what determines them as
well as their results. The neo-institutionalism was adopted for the theoretical and
methodological approach, in analyzings the study of the following dimensions: the
influence of the Supreme Court's role in the judgment of ADIN 1923-DF; the influence
of local politics and its agents to implement the new governance model in health; and the
functional independence of prosecutors. The methodological strategies were the
bibliography review and documentary analysis of normative acts, jurisprudence, print
and electronic media, pleadings and action scripts. A study of the performance of the
State Prosecution Service in São Paulo, has also been done, including interviews with
key agents, given the pioneering of this brazilian state in hiring SOs to manage health
facilities. This research has shown that validation of the new management model by the
courts was based on a political judgment, without having identified empirical basis for
its legitimacy. The technical-bureaucratic culture of prosecutors guided the
confrontation of this administrative innovation by its members. However, the
inarticulate way of hiring throughout the country favored the lack of uniformity in the
institution's activities, also influenced by the subjectivism and the different political and
ideological points os view that are justified under the scope of the functional
independence prerogative of prosecutors. Despite the rhetoric for the sake of efficiency,
transparency, economy and public participation used by the executive power to
implement the model of management by SO in health, inspection made by Prosecution
Service has revealed lack of participation and social control, wich are serious
deficiencies in health care, insufficient public control; corruption and massive
embezzlement of public funds. Today, the Prosecution Service is dedicated to improving
the monitoring of management contracts.
