O Poder Legislativo federal é representado pelo Congresso Nacional, composto pela Câmara dos Deputados e pelo Senado Federal. As duas casas legislativas são responsáveis pela proposição e aprovação do arcabouço legal do país incluídas as leis referentes ao setor da saúde. A Legislatura é representada pelo período de quatro anos de duração do mandato dos parlamentares que coincide com o mandato do chefe do Poder Executivo, deste modo é que a pesquisa tem como objetivo levantar e analisar as proposições legislativas sobre saúde apresentadas e tramitadas no Congresso Nacional no período das duas últimas legislaturas a fim de conhecer em profundidade a produção legal sobre saúde do parlamento federal brasileiro. Para tanto foi feita uma pesquisa exploratória e retrospectiva, de base documental secundária, com características quali e quantitativa na base de dados denominada Observatório da Saúde no Legislativo e estudo focalizado em tema selecionado. Os resultados demonstraram uma profícua produção de propostas legislativas em saúde de origem parlamentar, em especial nos temas da gestão e administração do Sistema Único de Saúde-SUS. Uma análise mais aprofundada de tema específico selecionado \2013 tabaco, álcool e outras drogas \2013 demonstrou que os parlamentares de perfil liberal foram os que mais propuseram questões sobre o tema. Foi concluído que a saúde tem o reconhecimento legislativo pelo Congresso Nacional em vista da abundância de proposições nos mais variados temas que envolvem a saúde da população, porém não se apreciou a conversão em lei da maioria dos projetos analisados, o que caracteriza uma baixa qualidade dos projetos ou falta de interesse do parlamento em transforma los em lei.
Abstract
The Federal Legislative Branch is represented by the National Congress, composed of the Chamber of Deputies and the Federal Senate. The two legislative houses are responsible for proposing and approving the legal framework of the country including laws relating to the health sector. The Legislature is represented by the four-year term of office of the parliamentarians, which coincides with the mandate of the head of the Executive Branch, so that the research aims to raise and analyze the legislative proposals on health presented and processed in the National Congress in the period of the last two legislatures in order to know in depth the legal production on health of the brazilian federal parliament. For this, an exploratory and retrospective study was carried out, with a documental base of 2nd hand, with qualitative and quantitative characteristics in the database called Health Observatory in the Legislative. The results showed a profitable production of legislative proposals on health of parliamentary origin, especially in the management and administration of the SUS. A more in-depth analysis of the selected specific topic - tobacco, alcohol, and other drugs - showed that liberal-minded (republicans) parliamentarians were the ones who most posed questions on the subject. It was concluded that health has the legislative recognition by the National Congress in view of the abundance of propositions in the most varied subjects that involve the health of the population, but it was not appreciated the conversion into law of most of the projects analyzed, which characterizes a low quality of the projects or lack of interest by the parliament in transforming them into law.
